1. Acceptance of Terms
By accessing, registering on, or purchasing any product from SportyPunter ("we," "us," "our," or "the Company"), you ("User," "Customer," or "you") agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and any additional policies referenced herein.
These Terms apply to all visitors, registered users, and customers of SportyPunter. If you do not agree with any part of these Terms, you must immediately stop using our website and services. Your continued use of SportyPunter after any updates to these Terms constitutes your binding acceptance of the revised version.
2. Description of Services
SportyPunter operates as a digital marketplace where customers can purchase pre-built, configurable automated bots, including but not limited to Telegram bots and other messaging or task-automation bots ("Products" or "Bots").
Our services include:
- Access to a catalogue of ready-made, configurable bots
- Delivery of bot configuration files, scripts, or deployment packages upon purchase
- Optional setup assistance where expressly stated on a product listing
- Customer account management
Important: SportyPunter is a vendor of pre-built bot software. We do not operate, host, or monitor your bots on your behalf after delivery. You are solely responsible for how you configure, deploy, and use any bot purchased from us. Bots are configured using credentials you provide - such as your Telegram Bot Token, Chat ID, or other API keys.
3. Eligibility
To use SportyPunter's services, you must:
- Be at least 18 years of age, or the legal age of majority in your jurisdiction, whichever is higher
- Have the legal capacity to enter into a binding contract
- Not be located in a country subject to an applicable government embargo, sanctions list, or trade restriction
- Not be barred from receiving services under any applicable local, national, or international laws
By using our services, you represent and warrant that you meet all of the above requirements. We reserve the right to suspend or terminate your access at any time if we determine, at our sole discretion, that you do not meet these requirements.
4. Account Registration and Security
4.1 Account Creation
To make a purchase on SportyPunter, you must register an account by providing accurate, complete, and current information, including your name, email address, and any other details requested during registration. You agree to maintain and promptly update your account information to keep it accurate.
4.2 Account Security
You are solely responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to:
- Keep your password secure and never share it with any third party
- Immediately notify SportyPunter at support@sportypunter.com upon becoming aware of any unauthorized use of your account or any breach of security
- Never allow another person to access or use your account
SportyPunter is not liable for any loss or damage arising from your failure to protect your account credentials.
4.3 One Account Per User
You may not create multiple accounts to circumvent restrictions, receive duplicate offers, or evade a suspension or ban. We reserve the right to merge or permanently terminate duplicate accounts without notice or refund.
5. Payment and Pricing
All purchases made on SportyPunter are subject to the listed price at the time of checkout. Prices may be subject to applicable taxes depending on your jurisdiction.
- All payments must be made in full before access to a purchased product is granted
- We accept payment methods listed at checkout, which may include bank transfer, card payments, or supported payment gateways
- By completing a purchase, you authorize SportyPunter to charge your chosen payment method for all fees incurred
- SportyPunter reserves the right to modify pricing at any time without prior notice; however, price changes will not affect purchases already completed
- If a payment fails or is reversed, access to the associated product may be suspended until full payment is received
6. No Refund Policy
6.1 All Sales Are Final
ALL PURCHASES MADE ON SPORTYPUNTER ARE STRICTLY FINAL AND NON-REFUNDABLE.
By completing a purchase, you expressly acknowledge and agree that you are not entitled to a refund, reversal, credit, or exchange of any kind, under any circumstances, once a transaction has been processed.
6.2 Reason for This Policy
Our products are digital goods - bot configurations, scripts, and software packages - that are immediately accessible and delivered to you upon payment. Because digital products cannot be physically "returned" and because access to the product is granted instantly, we are unable to offer refunds once a transaction is completed.
6.3 This Policy Applies To, But Is Not Limited To:
- Change of mind after purchase
- Failure to read the product description before purchasing
- Incompatibility with third-party platforms, including changes to the Telegram API or platform outages
- User error in providing incorrect credentials (Bot Token, Chat ID, Webhook URL, etc.)
- Partial use or non-use of a purchased product
- Technical issues arising from your own device, internet connection, server, or third-party services
- Account suspension or termination resulting from a violation of these Terms
- Dissatisfaction with the product after delivery
6.4 Exceptions at Sole Discretion
In rare and exceptional cases where SportyPunter has delivered a product that is materially and demonstrably different from what was described in the product listing at the time of purchase, and where you notify us within 48 hours of purchase with clear documented evidence, we may - at our sole and absolute discretion - offer a partial store credit or a product replacement. This does not constitute a monetary refund and does not create any obligation or precedent for any future cases.
6.5 Chargebacks and Payment Disputes
Initiating a chargeback or payment dispute with your bank or payment provider without first contacting SportyPunter and allowing us a reasonable opportunity to resolve the matter constitutes a breach of these Terms. We reserve the right to:
- Permanently ban accounts associated with fraudulent or unjustified chargebacks
- Dispute the chargeback and provide transaction evidence to the payment processor
- Pursue recovery through applicable legal channels
7. Bot Credentials and User-Provided Data
To configure and deploy a purchased bot, you will be required to provide certain credentials and configuration data, which may include:
- Telegram Bot Token
- Telegram Chat ID
- Webhook URLs
- Third-party API keys or integration tokens
By submitting these credentials, you:
- Confirm that you are the legitimate owner or properly authorized user of the credentials provided
- Accept full and sole responsibility for the security, use, and consequences of using those credentials
- Agree that SportyPunter may store and process these credentials solely for the purpose of configuring and delivering your purchased bot
- Acknowledge that SportyPunter is not liable if your credentials are compromised as a result of your own security failures, negligence, or third-party breaches outside our control
We do not use your credentials for any purpose beyond delivering the service you purchased. Please refer to our Privacy Policy for information on how credentials are stored and protected.
8. Acceptable Use Policy
You agree to use SportyPunter's products and services only for lawful, ethical, and permitted purposes. You must not use any bot purchased from SportyPunter to:
- Violate any applicable local, national, or international laws or regulations
- Send spam, unsolicited bulk messages, or promotional content without the prior consent of recipients
- Harass, threaten, abuse, intimidate, or harm any individual or group of people
- Distribute malware, viruses, phishing content, or any other malicious or harmful code
- Infringe upon the intellectual property, privacy, or other legal rights of any third party
- Engage in fraudulent, deceptive, or misleading activity
- Violate Telegram's Terms of Service or the terms of any other platform the bot is deployed on
- Conduct unauthorized large-scale data scraping or automated data harvesting
- Interfere with, disrupt, or damage SportyPunter's infrastructure, servers, or services
SportyPunter reserves the right to suspend or permanently terminate your account without prior notice if we determine, at our sole discretion, that you have violated this Acceptable Use Policy. No refund will be issued for accounts terminated due to policy violations.
9. Intellectual Property
All content on SportyPunter - including but not limited to the website design, graphics, text, bot source code, and software - is the exclusive intellectual property of SportyPunter or its licensors and is protected under applicable copyright, trademark, and intellectual property laws.
9.1 Licence Grant
Upon successful payment, SportyPunter grants you a limited, non-exclusive, non-transferable, revocable licence to use the purchased bot for your own personal or internal business purposes only. This licence does not grant you the right to:
- Resell, redistribute, sublicense, or commercially exploit the bot or its source code
- Modify and re-publish the bot as your own original product
- Claim ownership or authorship of any SportyPunter product
- Reverse-engineer, decompile, or disassemble the software beyond what is expressly permitted by applicable law
Any unauthorized use of our intellectual property may result in the immediate termination of your licence and will be subject to legal action.
10. Disclaimer of Warranties
SportyPunter provides all products and services "as is" and "as available" without warranty of any kind, either express or implied. To the fullest extent permitted by applicable law, we expressly disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, or non-infringement
- Warranties that our products will be error-free, bug-free, or uninterrupted
- Warranties as to the accuracy, reliability, or completeness of any product information
- Warranties that our products will remain compatible with future updates or changes to third-party platforms, including Telegram
Third-party platforms such as Telegram may update, modify, or restrict their APIs or policies at any time without notice, which may affect bot functionality. SportyPunter is not responsible for any disruptions, failures, or limitations caused by such external changes.
11. Limitation of Liability
To the maximum extent permitted by applicable law, SportyPunter, its officers, directors, employees, agents, and suppliers shall not be liable for any:
- Indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, business, or goodwill
- Business interruption or loss of anticipated savings
- Damages arising from your inability to access or use our services
- Damages resulting from unauthorized access to or alteration of your data or credentials
- Any other damages arising out of or in connection with these Terms or your use of our services, even if SportyPunter has been advised of the possibility of such damages
In no event shall SportyPunter's total cumulative liability to you exceed the total amount you actually paid to SportyPunter in the twelve (12) months immediately preceding the claim.
12. Indemnification
You agree to indemnify, defend, and hold harmless SportyPunter and its officers, directors, employees, contractors, and agents from and against any and all claims, liabilities, damages, losses, penalties, costs, and expenses - including reasonable legal fees - arising out of or relating to:
- Your use or misuse of SportyPunter's products or services
- Your violation of these Terms
- Your violation of any applicable law, regulation, or third-party right
- Your violation of Telegram's Terms of Service or any other platform's terms
- Any content transmitted or activity conducted through bots you have deployed
This indemnification obligation survives the termination or expiration of your account and these Terms.
13. Termination
SportyPunter reserves the right to suspend or permanently terminate your access to our platform at any time, without prior notice or liability, for any reason, including but not limited to:
- Breach of any provision of these Terms
- Fraudulent, abusive, or illegal activity
- Failure to pay amounts owed
- Any reason at our sole business discretion
Upon termination, your licence to use any purchased products is immediately revoked. No refunds will be issued upon termination, regardless of whether any unused portion of a purchase remains.
You may close your account at any time by contacting us at support@sportypunter.com. Closing your account does not release you from any obligations or liabilities accrued prior to the date of closure.
14. Changes to These Terms
SportyPunter reserves the right to update or modify these Terms at any time. When material changes are made, we will update the "Last Updated" date at the top of this document and notify you via email or an in-platform notice where appropriate.
Your continued use of SportyPunter's services following any modification constitutes your binding acceptance of the revised Terms. We encourage you to review this page periodically.
15. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Nigeria, without regard to its conflict of law provisions.
In the event of any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services, you agree to first attempt to resolve the matter informally by contacting us at legal@sportypunter.com. We will endeavour to respond and resolve the matter within 30 days.
If a dispute cannot be resolved informally, both parties agree to submit exclusively to the jurisdiction of the courts of Nigeria. You waive any right to participate in a class action lawsuit or class-wide arbitration against SportyPunter.
